Welcome to Cosmic Kids! The terms “we”, “us” and “our” refer to Cosmic Kids Trading Limited (trading as “Cosmic Kids” / “Cosmic Kids Yoga”), company number 12594183, registered office: Mercury House, 19–21 Chapel Street, Marlow, Bucks, United Kingdom, SL7 3HN.

Cosmic Kids operates this store and website, including all related information, content, features, tools, products and services (the “Services”). Our store is powered by Shopify.

These Terms of Service (the “Terms”), together with any policies referenced here, describe your rights and responsibilities when you use the Services. By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

 

SECTION 1 – ACCESS AND ACCOUNT

You confirm you are at least the age of majority in your place of residence and you consent to allow any minor dependants to use the Services on devices you own or manage. You may be asked to provide information (email, billing, payment, shipping). You warrant it is accurate and that you have the right to provide it. You are responsible for keeping your credentials secure and for all activity under your account. You may not sell, assign, or license your account.

 

SECTION 2 – OUR PRODUCTS

We try to display products accurately, but colours/appearance can vary by device settings. We do not warrant that any product will meet your expectations or match images exactly. Product descriptions may change without notice. We may discontinue products or limit quantities to any person, region, or jurisdiction.

 

SECTION 3 – ORDERS

When you place an order, you make an offer to purchase. We may accept or decline at our discretion; payment must be processed before acceptance. If we do not accept, modify, or cancel an order, we’ll attempt to notify you using the contact details provided.

Purchases are subject to our Return & Refund Policy [LINK]. You confirm purchases are for personal/household use and not for resale or export.

SECTION 4 – PRICES AND BILLING

Prices, discounts and promotions may change without notice. The price in your order confirmation applies at purchase time and typically excludes taxes, shipping/handling, and any customs or import charges unless stated.

You agree to provide current, complete, and accurate purchase and account information and to update it promptly. You represent that you are authorised to use any payment method submitted and will pay all charges (including applicable taxes and shipping).

SECTION 5 – SHIPPING, FULFILMENT & DELIVERY

We use third-party fulfilment partners (including print-on-demand suppliers) to produce and ship some items. Delivery times are estimates and not guaranteed; delays can occur due to carriers, customs, or events outside our control.

Risk & title: For consumer purchases, risk in the goods passes to you when you (or a person you nominate) take physical possession of them. If you arrange your own carrier, risk passes when we hand the goods to that carrier. This does not limit your statutory rights.

 

SECTION 6 – INTELLECTUAL PROPERTY

All content in the Services (trademarks, text, images, video, audio, design and arrangement) is owned by Cosmic Kids Trading Limited, its affiliates or licensors and protected by applicable laws. You may use the Services for personal, non-commercial use only. No licence is granted except as expressly set out here. Our names, logos, and marks are our trademarks; other names and logos are the property of their owners.

 

SECTION 7 – OPTIONAL TOOLS

We may provide access to tools offered by third parties on an “as is” and “as available” basis without warranties or endorsement. Your use is at your own discretion and risk and may be subject to the third party’s terms. New features/tools may be added and will also be subject to these Terms.

 

SECTION 8 – THIRD-PARTY LINKS

The Services may link to third-party websites or include third-party materials. We are not responsible for their content, accuracy, or practices. Access and use them at your own risk and review their terms and policies before transacting.

 

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Cosmic Kids is powered by Shopify, which enables us to provide the Services. Sales are made by Cosmic Kids Trading Limited, not by Shopify. By using the Services, you acknowledge that Shopify is not responsible for sales between you and us and you release Shopify and its affiliates from claims arising from those transactions.

 

SECTION 10 – PRIVACY POLICY

Personal information collected through the Services is handled per our Privacy Policy. Because our store is hosted by Shopify, Shopify also processes certain personal information to operate and improve the Services, which may involve transfers to other countries. SECTION 11 – FEEDBACK

If you submit ideas, suggestions, reviews, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute, and display it for any purpose. You warrant you own the Feedback or have rights to grant this licence and that your Feedback complies with these Terms. We may monitor, edit, or remove Feedback in our discretion.

SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS

Information in the Services may contain errors or omissions (e.g., descriptions, pricing, promotions, shipping charges, transit times, availability). We may correct, update, or cancel orders if information is inaccurate, at any time and without notice (including after submission).

 

SECTION 13 – PROHIBITED USES

You may use the Services only for lawful purposes. You agree not to, among other things: violate laws; infringe IP rights; harass or harm others; transmit misleading information; send spam; impersonate others; upload malware; scrape or collect personal data without consent; interfere with security features; or otherwise engage in conduct we deem harmful. We may suspend or terminate access for violations.

We may terminate or suspend access to the Services at any time in our discretion. You remain liable for amounts due up to the date of termination. Provisions that by nature should survive (e.g., IP, Feedback, Disclaimers, Liability, Indemnity, Governing Law) will continue to apply.

To the fullest extent permitted by law, in no event will Cosmic Kids Trading Limited, our directors, officers, employees, agents, partners, service providers, or licensors (or Shopify and its affiliates) be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, savings, data, or replacement costs, arising from or related to your use of the Services or any products. Nothing in these Terms limits liability that cannot be limited under applicable law.

 

SECTION 17 – INDEMNIFICATION

You agree to indemnify and hold harmless Cosmic Kids Trading Limited, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms, violation of law, third-party rights, or misuse of the Services.

SECTION 18 – SEVERABILITY

If any provision is unlawful, void, or unenforceable, it will be enforced to the maximum extent permitted and the remainder will remain in full force.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

Our failure to enforce any right is not a waiver. These Terms and any policies posted on the site constitute the entire agreement between you and us regarding the Services and supersede prior agreements. Ambiguities will not be construed against the drafting party.

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer them without restriction.

These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of England and Wales. You and we submit to the exclusive jurisdiction of the courts of England and Wales.
